EDPB issues statement on the ePrivacy Regulation

The European Data Protection Board (‘EDPB’) adopted, on 9 March 2021, a statement on the Regulation concerning the Respect for Private Life and the Protection of Personal Data in Electronic Communications and Repealing Directive 2002/58/EC. In particular, the EDPB welcomed the negotiation mandate adopted by the Council on the protection of privacy and confidentiality in the use of electronic communication services, and noted that the ePrivacy Regulation should complement and not de facto change the General Data Protection Regulation (Regulation (EU) 2016/679) (‘GDPR’), as well as outlined its position on the retention and processing of electronic communication data for law enforcement and national security, the confidentiality of electronic communications, cookie consent requirements, and the future role of supervisory authorities and the cooperation mechanism.

The EDPB highlighted that the new ePrivacy Regulation must enforce the consent requirement for cookies and similar technologies, as well as ensure effective ways of obtaining consent for websites and mobile applications to address, among others, consent fatigue.
